As reported in the Wall Street Journal in November, 2011, the White House has expanded its investigations of companies that employ illegal immigrants, notifying 500 companies of their intent to inspect hiring records.  In the 2011 fiscal year, the administration targeted nearly 2500 companies.  Audits by the U.S. Immigration and Customs Enforcement (ICE) agency can be detrimental for companies with violations, due to the possible loss of needed employees, legal fees associated with defending an investigation and the heavy fines associated with employing illegal workers.  In some cases, criminal penalties may be charged against culpable employees at all levels of the organization. Recently, wage-and-hour lawsuits surpassed discrimination suits as the most commonly filed employee action in civil courts.  According to an article in Insurance and Financial Advisor, the Department of Labor (DOL) estimates that 80% of employers are not in full compliance with wage-and-hour laws.  It is more important than ever for employers to ensure that everything about their timekeeping system, break and meal policies, and overtime accounting are applied consistently to all employees and are in compliance with the Fair Labor Standards Act (FLSA). DOL Will Focus on Restaurant Labor Violations in Hillsboro County, Florida

The Tampa District Office of the U.S. Department of Labor’s Wage and Hour Division has announced the launch of an enforcement initiative focusing on the restaurant industry in Hillsborough County, the most populous county in the greater Tampa Bay area. The reason for this initiative is that the division has found significant and systemic violations of the minimum wage, overtime and child labor provisions of the Fair Labor Standards Act at area restaurants. On March 18th President Obama signed the Jobs Bill into law.  The Hiring Incentives to Restore Employment (HIRE) Act is hoped to boost hiring by offering an employer exemption from Social Security payroll tax on wages paid to qualified employees that work from March 19, 2010 through December 31, 2010.

The maximum value of this credit is 6.2% of wages up to $106,800.  An additional business tax credit up to $1,000.00 can be earned if the qualified employee is retained for 52 consecutive weeks.  This credit will be taken on the employer’s 2011 income tax return. Click here for more information.
