Restaurant Chain Partners with Oasis Outsourcing to Grow its Business

How it All Started: EEOC Claims, Lawsuits and Workers’ Comp Claims

It began nearly four years ago when a growing restaurant chain reached out to Oasis for help. An increasing number of EEOC claims, lawsuits and workers’ compensation claims were burdening management and taking the focus away from the core business. Not only was this a time-consuming distraction, but without proper documentation or process in place for hiring and firing or consideration for applicable state or federal employment laws, the business was exposed to significant financial risk.

When the restaurant selected Oasis as its partner, Oasis’ team of Human Resources professionals conducted interactive trainings for managers in the areas of employment law, harassment, progressive discipline, and proper documentation practices for hiring and firing as well as provided consultations on specific employment matters. During the first year, the number of lawsuits and EPLI claims was down significantly and this trend has continued, including one year with no claims at all. Additionally, improved safety practices have also led to a reduction in workers’ compensation claims, resulting in more money staying in the restaurant’s pockets.

The Next Challenge: Reducing Turnover

It’s well known that high turnover is a fact of life in the restaurant industry. However, to retain key employees, this restaurant chain took a progressive step forward and not only adopted Oasis’ medical benefits, but also instituted Oasis’ 401(k) plan. Oasis handles the Affordable Care Act (ACA) tracking, reporting and compliance, and proactively identifies hourly employees that are eligible for benefits. Turnover at some levels and seasonal hiring are of course still part of the restaurant business, but Oasis’ electronic onboarding makes it a seamless process to quickly bring on new employees.

Compliance: Ahead of the Game on the FLSA Wage and Hour Regulations from the DOL

In May 2016, the final ruling was published containing updates to the regulations defining which white collar workers are protected by the FLSA’s minimum wage and overtime standards.  Oasis and the restaurant chain met several times to review the impact, identify employees who might require a change in classification, determine the appropriate course of action and structure an effective communication strategy to the impacted employees. Several months before the regulation was set to go into effect, the business was well ahead and already operating in compliance with the new regulations.

The Results

The partnership between the restaurant and Oasis resulted in drastically lower lawsuits and workers’ compensation claims, decreased turnover of key employees and an effective compliance plan for the FLSA wage and hour regulations from the DOL that was put in place well ahead of the effective date.
