The Fair Labor Standards Act (FLSA) is a complicated law that sets the terms for wages and hours worked that most employers in the United States must follow. While penalties for wage and hour violations can be substantial, the law itself is often misunderstood, and its implementation can be counterintuitive. Employees who are covered by this law actually are referred to in the negative: While exempt employees are exempt from the overtime provisions of the law; non-exempt employees must be paid overtime for extra hours worked.
Federal law (Title 13, Part 121 of the Code of Federal Regulations) sets forth in detail the criteria to be used by the Small Business Administration (SBA) in determining the definition of a “Small Business.” This criterion includes items such as sales volume and number of employees.
