The concept of “Employment-at-Will” is not as simple as it may sound. The definition clearly states that the employer or employee may terminate the employment relationship with or without cause at any time.
As a Human Resources Consultant, I occasionally encounter an employer who clings to the “Employment-at-Will” doctrine to support any terminations of employees. Although it is true that the at-will employment relationship allows either party (employer/employee) to terminate the employment relationship with or without cause or notice at any time, termination decisions should never be made haphazardly in the highly litigious employment environment we currently find ourselves.
One of the most important, but often overlooked, benefits an employer can offer to its employees is a solid EAP or “Employee Assistance Program.” This confidential program, which gives employees access to trained professionals to discuss a host of personal problems and issues can be of tremendous importance to employees. Therefore, if they avail themselves of the program, it is appreciated to a level beyond virtually any other benefit an employer can offer.
