As of 2014, employers may not impose a waiting period for medical benefits of more than 90 days. Employers will be fined for each full-time employee in a waiting period beyond 90 days. This is part of Healthcare Reform, also known as the Affordable Care Act, or ACA.
Misclassification of workers is not a new problem in the U.S. One of the most notable cases of worker misclassification to date occurred with Microsoft. The IRS audited Microsoft and determined that it had misclassified 10,000 independent contractors who failed the common-law test. Substantial fines and penalties were levied against the corporation. Those common-law employees, who later sued the company for right to past benefits including the employee stock purchase program, were awarded a $97 million settlement.
The Obama Administration announced on July 2, 2013, that the employer mandate under the Patient Protection and Affordable Care Act (Affordable Care Act) will be delayed until 2015, thus giving employers an extra year to comply with the law’s complicated hours-tracking and health insurance reporting rules.
