If you could take a guess, how many employers nationwide would you estimate conduct criminal background checks on job applicants as part of their hiring process? According to a recent Society for Human Resource Management survey (results published July 2012), over 80% of employer respondents indicated that applicant criminal background records were reviewed during the hiring process. Specifically, 69% of organizations reported that they conducted criminal background checks on ALL of their job candidates; and 18% of organizations used criminal background checks for select positions. The Fair Labor Standards Act (FLSA) is a complicated law that sets the terms for wages and hours worked that most employers in the United States must follow. While penalties for wage and hour violations can be substantial, the law itself is often misunderstood, and its implementation can be counterintuitive. Employees who are covered by this law actually are referred to in the negative: While exempt employees are exempt from the overtime provisions of the law; non-exempt employees must be paid overtime for extra hours worked.
